Since the California Supreme Court’s 2018 Dynamex decision, Sheila has been advising her clients on how to adapt to the new “ABC test” that required many employers to shift their independent contractors to employee status. You have likely heard about the issues around employee classification for rideshare and delivery workers, but Dynamex and the legislation following it have greatly shifted the way all independent contractors and employers operate in many businesses throughout California. Sheila will update you on the status of worker classification in California, including the implications of the recently-chaptered AB-2257 and the potential outcomes of Proposition 22.

John Goralka will share a recent agriculture case in which his clients obtained a $2.7 million estate tax REFUND. Supplemental information was filed AFTER the original 706 return was prepared and filed by another firm. The REFUND was obtained AFTER an IRS AUDIT. John will review the factors of the original 706 return which indicated a savings may be possible, the steps he took to avoid the lien otherwise required for 6166 payments and how he negotiated with the IRS auditors. This happened in our backyard!

Income tax planning for trust and estate distributions is an easily overlooked question when drafting trusts.  Even when the time comes to administer a trust or an estate, tax planning for distributions may not get the attention it needs.   The federal income tax rates punish trust and estates that accumulate more than a modest amount of income each year.   Trusts and estates that hold interests in partnership or S corporations create another level of complexity.  Add to that the state law rules that tell us which receipts are trust income and which are trust principal, and you set the table for tricky choices come tax time.

This session will give you practical guidance on the drafting choices and planning strategies to manage and minimize the tax consequences of making (or not making) distributions to estate heirs and trust beneficiaries.
